Mr Marco Breitenmoser, as well as the clerks authorised to draw up statements of facts, will draw up precise and impartial statements of facts at your request, listing a set of factual elements which will ensure substantial protection against the occurrence of possible misfortunes which could disrupt your daily life.
The bailiff's report is a form of evidence that makes it possible to establish the reality of a situation at a given time. It is a neutral and objective description of the facts, without any consideration, opinion or judgment. The report may also contain photographs.
There are different types of bailiff's report: the report that describes a physical reality; the report on the Internet (the bailiff will note the presence of certain online content, either by taking screenshots or by describing what he sees); the report on SMS or voice messages (the bailiff transcribes and notes the presence of voice and/or written messages). The time-stamped statement of deposit enables the creator of a work to protect himself against counterfeiting or plagiarism by showing that his work was created first.
The person requesting the statement is free to determine the moment that he or she deems most appropriate for the bailiff to intervene. It is best to have the facts established as soon as possible, before the thing, the event or the damage disappears. The bailiff can intervene day and night, even on Sundays, unless the report is made in a private place.
The statement of facts can be used to prove a very large number of situations. It can be done as a preventive measure before work is carried out, or to take stock of a flat, to establish the progress of work, various defects, the encroachment of a neighbour on your property, forgery, the proper conduct of a general meeting, failure to observe childcare arrangements, etc.
The main purpose of the bailiff's report is to be able to set in stone elements that may disappear. It will be a key piece of evidence in the event of a dispute before a court.
